Florida Lawmakers Explore Changing Unique Law

Florida Republicans are seeking to amend a Florida law that would make it illegal for Gov. Ron DeSantis (R), must resign from his office if he runs for president.

What is the law?

Florida law requires elected officials to resign if they are seeking another office whose term would overlap with their current one.

The law states that no one may be a candidate for more than one office: federal, state, county, municipal or district. “An officer cannot be a candidate in another state, district or county, or municipal office without resigning from his or her current office.”

It states that “The resignation cannot be rescinded.”

What is the role of legislators?
Florida Republicans openly claim that the law should not be amended to affect DeSantis.

Politico reported that both Paul Renner (R, Florida state House Speaker) and Kathleen Passidomo, the state Senate President, believe it’s a “good idea” for DeSantis to be able to continue his run for president.

Passidomo stated, “If an individual who’s Florida governor is running to be president, I believe he should have the right to do so.” “I do. It’s an honor and privilege to be able to do that, so it is a great idea.

Renner stated that he believes the law needs to be amended because Florida legislators have been inconsistent about the “resign-to run” statute.

Renner stated, “You’ll find me to always strive to be principled and consistent.” This is one area where, looking back in history — you don’t have to go far on a type of two-second Google Search — we’ve been completely inconsistent on. You would be correct if you believe that it’s based upon anything in your hypothetical. I will be open and transparent about this.

In 2008, the law was amended to permit then-Gov. Charlie Crist could run for the vice presidency to be John McCain’s running-mate. This, however, was not possible because McCain chose to be the then-Alaska Governor. Sarah Palin.

Florida legislators amended the law again in 2018, restoring “resign-to run” provision.
