The Fourteenth Amendment, Section 3, states: “No one shall be a senator or representative in Congress, nor elector of President or Vice-President, and no person shall hold any office, civil, military or federal under the United States or under any State if they have previously taken an oath as a member or officer of the United States or a member of any State legislature or executive or judicial officers of any State to support the Constitution.” However, Congress can remove such disability by a vote of at least two-thirds of each House.
This was done to prevent unrepentant Confederates from holding public office following the Civil War. However, many did hold office as Congress did more often than not vote to lift the prohibition. It’s being used against Madison Cawthorn, America-First Rep. (R-N.C.), even though he’s fighting back. It could also be used against other members of the Jan. 6 insurrection.
Cawthorn, and all the rest, would be just a dry run. They believe that Donald Trump is the great white whale Captain Ahabs is looking for. This is the last stake Democrats and established Republicans can drive into Trump’s heart, ending his 2024 ambitions.

This scenario has two problems: Biden has stated that he won’t pardon Trump and there isn’t anything to pardon Trump because Jan. 6 was not an insurrection. Some Leftist academics believe that there is an easy way to get rid of Trump. Mark Graber, a University of Maryland law professor, stated that a court could determine if a person participated in an attempt to overturn a valid election result. It is not more difficult than to prove that someone aided or supported illegal activity. It is possible to prove that someone aided or supported illegal activity.
Democrats and their Republican establishment allies continue to fabricate lies after lies. After insisting for more than a year that Jan. 6 Capitol breach was an attack on “our democracy”, and worse than Pearl Harbor and 9/11, they are now beginning to build upon the foundation they have laid to use the Fourteenth Amendment against Trump.
The push to use the Fourteenth Amendment to stop Trump may still succeed. All the Democrats need is the votes to get it over. They may be able to find enough willing establishment Republicans to support them. The establishment media will then hail the people who saved our democracy by giving Trump the coup de grace. There is no downside for them.
